TERMS & CONDITIONS This Customer Service Agreement (the "Agreement") is entered into between the customer (hereinafter referred to as the "Customer") and 3 Gems Pty Ltd trading as Adsforbreakfast (hereinafter referred to as the "Provider"). This Agreement outlines the terms and conditions governing the provision of services by the Provider to the Customer. 1. SERVICES The Provider agrees to deliver digital advertising services to the Customer as described in the service outline provided by the Provider. The Customer acknowledges that the Provider is the sole entity responsible for the development, delivery, and content of the services. 2. PAYMENT The Customer agrees to pay the fees specified by the Provider for the advertising services. All payments shall be made as outlined in the payment terms provided by the Provider. 3. INTELLECTUAL PROPERTY The Customer acknowledges that all materials, including but not limited to content, strategies, videos, and any intellectual property provided by the Provider, are the exclusive property of the Provider. The Customer may not reproduce, distribute, or sell these materials without the Provider's express written consent. 4. DISCLAIMER AND LIMITATION OF LIABILITY a. The Provider does not guarantee any specific results from the advertising services and shall not be held liable for any business or financial outcomes the Customer may experience. b. The Provider makes no warranties, express or implied, with respect to the services provided, and disclaims any implied warranties of merchantability or fitness for a particular purpose. c. To the extent permitted by Australian law, in no event shall the Provider be liable for any indirect, consequential, special, incidental, or punitive damages arising out of or in connection with this Agreement or the provision of advertising services. 5. TERMINATION The Provider reserves the right to terminate this Agreement and the provision of services to the Customer at any time for any reason, subject to the provision of reasonable notice as required by Australian law. 6. CONFIDENTIALITY Both parties agree to maintain the confidentiality of all information shared, whether business, financial, or technical, and shall not disclose such information to third parties. 7. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the laws of [Your State/Territory], Australia, without regard to its conflict of laws principles. 8. REFUNDS Our refund policy complies with Australian Consumer Law. If our services fail to meet consumer guarantees, you may be entitled to a remedy such as a refund, replacement, or having the services re-performed. For minor issues, we reserve the right to first attempt to remedy the problem. In cases where consumer law does not apply (e.g., change of mind), refunds are at our discretion. We encourage customers to contact us with any questions or concerns prior to making a purchase. 9. ENTIRE AGREEMENT This Agreement represents the entire understanding between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties. 10. PRIVACY The Provider will collect, use, and protect the Customer's personal information in accordance with the Australian Privacy Principles and our Privacy Policy. 11. DISPUTE RESOLUTION Any disputes arising from this Agreement will first be subject to good faith negotiation between the parties. If unresolved, the dispute may be referred to mediation or arbitration in accordance with Australian law. The parties hereto have executed this Customer Service Agreement as of the date of purchase.
